Kaepernick faces another uphill struggle

As the NFL gears up for week seven of its regular season, Colin Kaepernick finds himself still team-less and embarking on a collusion case against the league's owners.

We discussed the legal action with Sports Illustrated’s Robert Klemko - who believes that the quarterback's case is facing an uphill battle:

"The odds are stacked against him. For one, he has to prove that the collision occurred in the last 90 days according to their collective bargaining agreement. He also has to prove, whether it's a written form of communication or otherwise, that more than one owner, or an owner and the NFL league office communicated to the extent of saying, 'Hey, don't sign this guy.'

"If it's just two owners talking over email criticising his politics, that's not enough evidence for collusion," he told Off The Ball.

He added that he is unlikely to be picked up by a franchise during the current season:

"I think the idea that he would come in and rescue a team like Greenbay's season after losing Aaron Rodgers is a little bit far-fetched."

However, he also stated that he believes the former 49er is "obviously one of the top 64 quarterbacks in the NFL," and that his stats and previous record suggest that he "would be on a roster if not for the protest."

Given the level of tension between players and 'the league,' he believes that any deal agreed by the players association and the NFL will upset some athletes:

"The backlash to whatever solution they come up with will be exasperated by the fact that all of these players have Twitter at their fingertips and can say whatever they want about whatever is agreed upon as soon as it's announced and undermine what the NFL would otherwise consider a success."
