Pat Hickey's legal team is warning he needs to come home from Brazil for treatment of a heart condition.
The Former President of the Olympic Council of Ireland (OCI) had his passport confiscated in August when he was arrested in Rio, but a trial date has yet to be set for the case.
The 71-year-old Mr Hickey wants to be allowed to leave Brazil, where he has been for the past several months, as he awaits to face the charges on ticket touting.
Mr. Hickey's legal team have already applied to have his passport returned, and speaking to the Irish Independent, solicitor Simone Kamenetz said that Hickey needs to return home for a "delicate heart procedure".
"He suffers from atrial fibrillation, and the cardiologist who saw him already twice, Dr Claudio Domenico, a well known and reputable physician, established that Mr Hickey's situation is preoccupying," Kamenetz explained.
"Mr Hickey must undergo a delicate heart procedure and he should be allowed to do it with his doctors that have been following his health conditions already for years, with his family alongside with him," she added.
Speaking to Newstalk, Irish Times correspondent Ian O'Riordan stated that he was wary of the claims.
"He is out there for over two months now, on his own without access to any of what he claims to be the medical attention he needs. He is due a procedure [...] but this is coming from his lawyers, so you don't know how this is appealing to the legal system out there."
Earlier this week, John Delaney resigned from his position as vice-president of the OCI, emphasising that: "I had no role or involvement in the OCI's handling of ticketing arrangements for the Rio Olympic Games."
The OCI stated on Thursday evening that they would not be viewing an independent report into the ticketing arrangements for the 2016 Games - which is due to be completed in November - and that it would be passed on directly to Judge Carroll Moran.
